Terms & Conditions of Use

By accessing or using the CineMob website, mobile application, APIs, or any other content, features, or services offered, owned, or operated by CineMob (“CineMob,” “we,” “us,” or “our”) (collectively, the “Service”), you agree to be bound by these Terms and Conditions of Use (“Terms”). If you do not agree to these Terms, you may not access or use the Service. Please also review our Privacy Notice, which explains how we collect, use, and share personal data. By using the Service, you acknowledge and agree that the Privacy Notice applies to your use of the Service. All references to “you” or “your” mean the individual who accesses or uses the Service, including any heirs, assigns, or successors.

 

IMPORTANT NOTICE FOR U.S. USERS: THESE TERMS CONTAIN MANDATORY BINDING ARBITRATION AND A CLASS ACTION WAIVER, WHICH AFFECT YOUR LEGAL RIGHTS. PLEASE READ THE SECTION TITLED “DISPUTE RESOLUTION; ARBITRATION; CLASS ACTION WAIVER” CAREFULLY.​

  • The CineMob Service: CineMob is a community-driven platform that enables members to discover films, create and join group screening events (“Mobs”), interact with other members, and participate in film-related discussions and activities. The Service may change over time. We may add, remove, or modify features at any time.
     

  • Private Membership Club: 

    • ​CineMob operates as a private membership film club: The Service is intended for registered members and invited guests (where permitted) to participate in member gatherings and community activities, including film-related events (“Mobs”).

    • No public admission: CineMob does not offer public admission to member gatherings. Access to any mob, screening, or event is limited to eligible members in good standing and may require confirmation, capacity limits, venue rules, and compliance with these Terms.

    • Guests: Where permitted, members may invite guests. Members are responsible for their guests’ conduct and compliance with these Terms. Guests may be required to register or agree to certain terms before attending.

    • Right to refuse or revoke access: We may deny, suspend, or revoke access to the Service or any mob/event, in our reasonable discretion, including to maintain safety, comply with venue or licensing requirements, or enforce our community standards.

    • Venues and third parties. Events may take place at third-party venues (including cinemas). Your attendance is also subject to any venue policies and applicable rules, including safety and conduct requirements.

    • No guarantee of availability: Membership does not guarantee access to any specific event, film, venue, seat, or time.

  • License and Acceptable Use: Your access to the Service is licensed, not sold. Subject to these Terms, CineMob grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use. All rights not expressly granted to you are reserved by CineMob and its licensors.​​

  • Eligibility and Account Registration: In order to use the Service, you must be at least 13 years old. When you register to use the Service, you agree to provide accurate, current, and complete registration information, and to maintain and promptly update your Registration Information in order to ensure that it remains true, accurate, current and complete. You are responsible for all activity that occurs under your account.

  • Account Security: You are responsible for safeguarding your login credentials and for any activity that occurs under your account, whether or not authorized by you. You must notify us immediately if you suspect unauthorized access or use of your account. To the extent permitted by law, CineMob is not liable for losses resulting from unauthorized use of your account. Privacy and data rights. Your privacy rights, including how to access or request deletion of your personal data, are described in our Privacy Notice, which forms part of these Terms.

  • Community Conduct: CineMob is a community platform. You agree to engage respectfully and lawfully. You must not:

    • Harass, threaten, abuse, or intimidate others

    • Post hateful, discriminatory, or violent content

    • Misrepresent your identity or create multiple accounts to manipulate the Service

    • Disrupt community discussions or events

    • Spam, solicit, or engage in deceptive practices

    • Attempt to game or manipulate voting, mob creation, or engagement mechanics

    • Encourage or facilitate unlawful behavior

​We reserve the right to consider off-platform behavior when it directly impacts the safety or integrity of the CineMob community.

  • Prohibited Conduct
    You may not:

    • Use the Service for illegal or unauthorized purposes

    • Circumvent security features or access controls

    • Reverse engineer, decompile, or scrape the Service

    • Use automated tools (bots, scrapers, scripts) without our written permission

    • Introduce malware or harmful code

    • Use the Service to build or operate a competing business

    • Reproduce or redistribute Service content except as expressly permitted​
       

  • User-Generated Content: The Service allows you to post content, including comments, messages, event participation, and other materials (“User Content”). You retain ownership of your User Content. However, by submitting User Content, you grant CineMob a non-exclusive, royalty-free, worldwide, perpetual, sub-licensable license to host, store, use, reproduce, modify, display, and distribute your User Content solely in connection with operating, improving, and promoting the Service.

  • You represent and warrant that:

    • You own or have the rights to your User Content

    • Your User Content does not infringe third-party rights

    • Your User Content complies with these Terms and applicable law
       

  • ​Content Moderation and Removal: We may, but are not required to, monitor or review User Content. We reserve the right to remove, restrict, or disable access to any User Content or account that violates these Terms or is otherwise objectionable, harmful, or unlawful, in our sole discretion. We are not responsible for User Content posted by others.
     

  • Payments, Fees, and Subscriptions: Certain features of the Service may require payment. Payments are processed by third-party payment providers such as Stripe. We do not store full payment card details. By purchasing paid features, you authorize us (and our payment providers) to charge your selected payment
    method for applicable fees, taxes, and transaction costs.

  • Unless otherwise stated or required by law:

    • Payments are non-refundable

    • Prices may change with notice

    • Subscription terms and renewal conditions will be disclosed at the time of purchase
       

  • Intellectual Property: All intellectual property in the Service—including software, design, trademarks, logos, and content (excluding User Content)—is owned by or licensed to CineMob. You may not copy, modify, distribute, or exploit any part of the Service without our express written permission.
     

  • Third-Party Services: The Service may link to or integrate with third-party services (e.g., payment processors, analytics providers). We do not control and are not responsible for third-party services. Your use of them is governed by their own terms and policies.

  • Disclaimer of Warranties: TO THE EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee that the Service will be uninterrupted, secure, or error-free.
     

  • Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW. CINEMOB SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.​
     

  • Indemnification: You agree to indemnify and hold harmless CineMob and its affiliates from any claims, damages, losses, or expenses arising from: Your use of the Service, Your User Content, Your violation of these Terms or applicable law.
     

  • Termination: You may stop using the Service at any time. We may suspend or terminate your account or access to the Service at any time, with or without notice, where permitted by law, including for violations of these Terms or for security or legal reasons. Sections that by their nature should survive termination shall survive.​
     

  • Dispute Resolution; Arbitration; Class Action Waiver (U.S. Users): Where permitted by law, any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration on an individual basis, and not as a class action. You waive the right to a jury trial and to participate in class or representative actions. You may opt out of arbitration by providing written notice within 30 days of first accepting these Terms. (This section does not apply where prohibited by law, including for users in the UK/EU.)
     

  • Governing Law United States users:

    • ​Delaware law, excluding conflict-of-law principles

    • UK / EU users: English law, with local consumer protections preserved

    • All other users: Laws of the jurisdiction where CineMob is established
       

  • Changes to These Terms: We may update these Terms from time to time. If changes are material, we will provide notice as required by law. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.​
